What exactly was banned? When I first heard about prop h8te I took as they were basically trying to take away every right from same sex couples but then I watched an interview with one of the leaders of this crap and she said that they weren't trying to take away their rights for benefits or to adopt children they just didn't want them to be able to call their unions marriage. Which if you think about it isn't as bad as it could be. I mean, it's still crap since marriage means nothing anymore (not even to straight couples) but still. So...are same sex couples in California still allowed to adopt and share benefits and are only prohibited from getting married OR did prop h8te pretty much discriminate the crap out of us again? I think it's the former because before gay marriage was legalized there was a law in place that prohibited same sex couples from basically doing everything but have sex and live together but it was deemed unconstitutional by the supreme court and was overturned. So this year prop h8te leaders changed fourteen words so that it read something like, "Marriage will not be considered valid unless it is a union between a man and a woman" I'm not sure if that was all the prop consisted of but if I still lived in California I would much rather not be able to call my union marriage than to not be able to have children or share benefits with my partner. Prior to the California State Supreme Court finding that the equal rights clause of the California State Constitution requires extending full marriage rights to same-sex couples, California already had one of the country's most progressive domestic partnership laws, basically (if I understand this correctly) granting all of the same rights of marriage. (With the exception of federal benefits, but those are not recognized by federal government in any case.) The issue was whether it should be a separate institution for same-sex couples or the inclusion of same-sex couples in marriage. So right now same-sex couples still retain the benefits. I totally understand and sympathize with the argument that this still sends a message of inequality! However, I also think that more attention should be paid to the situation of gay couples of Florida and Arizona. Not only did those states also pass ballot initiatives banning same-sex marriage, but they don't even have domestic partnership or civil union laws. So, basically, same-sex couples in those states have no legal standing at all (and I'm pretty sure Florida bans adoptions by gay couples). I think issues such as gay marriage and abortion should be left completely up to the individuals. This country was built on the concept of separation on state and church, but for some reason, they're just unwilling to completely give in to it. The reason they want to ban gay marriage is because it is considered "morally wrong" and against God, which does not sound like secularism to me. Those who wanted the ban, say "marriage has been protected!" LAMO like gay people are the Grinches of marriage! Well, they ended race-based restrictions on marriage, so why are they still after gay couples? It's sad how conservative and closed-minded America really is... Whatever happened to life, liberty and the pursuit of happiness?? If marrying my girlfriend makes me happy, why in the world is the government telling me no?? And yes, domestic partnerships or civil unions would be better than nothing in Arizona, Florida and many other states, as well as adoption and artificial insemintation laws for gays. Basically what same sex marriage supporters say (and I agree) is that the anti-gay laws and ammendments to the state or federal constitutions are illegal and discriminatory. If we all want to change the meaning of marriage to ONLY mean religious ceremonies, and make ALL civil marriage called something else, then fine. But until then, everyone should have the right to be married, along with all the rights and priviledges including federal benefits- idealistically. Now that's not as much of an issue, I don't see why they should still be pressing it the way they are.
